Terms of Service

Welcome to Payasap. These Terms of Service ("Terms", "Agreement") constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and Payasap ("we," "us," or "our"), concerning your access to and use of the Payasap mobile application as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto (collectively, the "Services").
1. Acceptance of Terms
By creating an account and using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use our Services. We may amend these Terms at any time by posting the amended terms on our site. We may or may not post notices on the homepage when such changes occur.
2. Eligibility
To be eligible to use our Services, you must be at least 18 years old and a resident of a country where our services are available. You represent and warrant that you have the full right, power, and authority to enter into and comply with this Agreement. You may be required to complete a verification process (KYC/KYB) before you can use all features of the Services.
3. Our Services
Payasap provides a platform for:
- Currency Conversion: Converting between supported fiat currencies (NGN, ZAR, GHS) and digital assets (USDT). Rates are provided at the time of the transaction and are subject to market fluctuations.
- NGN Accounts: Provision of a unique Nigerian Naira (NGN) account for sending and receiving funds. These accounts are provided through our licensed financial partners.
- Virtual USD Cards: Creation and management of virtual US Dollar (USD) debit cards for online payments. Usage may be subject to spending limits and acceptable use policies.
- Utility Bill Payments: Facilitating payments for various third-party services such as airtime, data, and electricity. We act as an intermediary and are not responsible for the services provided by the utility companies.
4. User Responsibilities
You are responsible for:
- Maintaining the confidentiality of your account credentials, including your password and any multi-factor authentication codes.
- All activities that occur under your account. You must notify us immediately of any unauthorized use.
- Providing accurate and complete information during registration and keeping it up to date.
- Ensuring that your use of the Services complies with all applicable laws and regulations.
5. Prohibited Activities
You agree not to use the Services for any of the following prohibited activities:
- Any unlawful activity, including but not limited to fraud, money laundering, financing of terrorism, or spreading illegal gambling.
- Impersonating any person or entity or misrepresenting your affiliation with a person or entity.
- Interfering with or disrupting the integrity or performance of the Services.
- Attempting to gain unauthorized access to the Services or its related systems or networks.
- Engaging in any activity that could harm us, our partners, or other users.
6. Fees and Charges
You agree to pay all applicable fees for the Services, as disclosed to you at the time of a transaction or as listed in our fee schedule. We reserve the right to change our fees at any time. All fees are non-refundable unless otherwise stated.
7. Termination
We may suspend or terminate your access to the Services at our sole discretion, without notice, for any reason, including for a breach of these Terms. Upon termination, all licenses and rights granted to you in these Terms will immediately cease.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PAYASAP, ITS AFFILIATES, AGENTS, DIRECTORS, EMPLOYEES, SUPPLIERS OR LICENSORS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE USE OF, OR INABILITY TO USE, THIS SERVICE.
9. Governing Law and Dispute Resolution
This Agreement shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria, without regard to its conflict of law principles. Any dispute arising out of or in connection with this Agreement shall be resolved through binding arbitration in Lagos, Nigeria.
